Terms and Conditions of Sale
Article 1 – Purpose
These general terms and conditions govern the sales of clothing and accessories by gros cœur. By accessing, browsing, and using the website to place an order, the buyer fully and unreservedly accepts these general conditions.
Article 2 – Prices
The prices of our products are indicated in Euros, all taxes included (VAT and other applicable taxes on the day of the order), unless otherwise indicated, and excluding processing and shipping costs.
International Orders: For orders shipped to a country other than mainland France, you are the importer of the products concerned. Customs duties, local taxes, import duties, or state taxes may be payable. These duties and sums are not the responsibility of gros cœur; they will be at your expense and are your sole responsibility, both in terms of declarations and payments to the competent authorities in your country.
Price Changes: gros cœur reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the rate in effect at the time of the validation of the order, subject to availability.
Retention of Title: The products remain the property of gros cœur until full payment of the price. However, as soon as you take physical possession of the products ordered, the risks of loss or damage to the products are transferred to you.
Article 3 – Orders & Validation
Any order placed on the website implies full and complete acceptance of these Terms and Conditions of Sale, without exception or reservation. All the data provided and the recorded confirmation will serve as proof of the transaction. gros cœur reserves the right not to record a payment and not to confirm an order for any reason whatsoever, particularly in the event of a supply problem or an issue concerning the order received.
Article 4 – Payment
Validating your order implies your obligation to pay the indicated price in full. Payment for your purchases is made by credit card through secure systems such as Stripe (for Apple Pay and Google Pay) or PayPal. The card is charged directly upon validation of your order on our site.
Article 5 – Right of Withdrawal & Returns
In accordance with consumer protection laws, you have a withdrawal period of 14 days from the receipt of your products to exercise your right of withdrawal without having to provide a reason or pay a penalty.
Conditions: Returns must be made in their original, unworn, and unwashed condition, complete with packaging and accessories. Any damage suffered by the product during this process may void the right of withdrawal.
Exceptions: The right of withdrawal does not apply to purchases of goods made to the specific request of the buyer or heavily personalized items.
Costs & Refunds: The return shipping costs are your responsibility. In the event of exercising the right of withdrawal, gros cœur will refund the sums paid within 14 days following the notification of your request, via the same payment method used during the order.
Article 6 – Availability
Our products are offered as long as they are visible on the site and within the limits of available stocks. In the event of product unavailability after placing your order, we will inform you by email. Your order will be automatically canceled, and no bank debit will be made.
Article 7 – Delivery
The products are delivered to the delivery address indicated during the ordering process. In the event of a delivery delay, an email will be sent to inform you of any consequences on the delivery time. gros cœur cannot be held responsible for delayed delivery due exclusively to the customer’s unavailability after several appointment proposals by the carrier.
Article 8 – Legal Warranties
All our products benefit from the legal guarantee of conformity and the guarantee against hidden defects provided by French law (Articles 1641 and following of the Civil Code).
Consumers have a period of two years from the delivery of the goods to act on the legal guarantee of conformity in the event of a defect.
In the event of non-conformity, the product may be returned, exchanged, or refunded. All complaints, requests for exchange, or refunds must be made by email.
Article 9 – Liability
The products offered comply with current French legislation. gros cœur cannot be held liable in the event of non-compliance with the legislation of the country where the product is delivered; it is your responsibility to check with local authorities regarding the import or use of the products. Furthermore, gros cœur cannot be held responsible for damages resulting from the misuse of the purchased product.
Article 10 – Intellectual Property
All elements of the gros cœur website are and remain the exclusive intellectual property of the company. No one is authorized to reproduce, exploit, redistribute, or use for any purpose whatsoever, even partially, elements of the site, whether software, visual, or audio.
Article 11 – Personal Data
gros cœur reserves the right to collect personal information and data concerning you, which is necessary for the management of your order and the improvement of our services. They may be transmitted to companies that contribute to these relations, such as those responsible for the execution of services and orders. You have the right to access, rectify, and oppose personal data concerning you.
Article 12 – Applicable Law & Disputes
The language of this contract is French (with English translations provided for convenience), and these terms of sale are subject to French law. In the event of a dispute, the buyer may first contact the seller to seek an amicable resolution. If no agreement is reached, the buyer has the right to resort free of charge to a consumer mediator. If mediation fails, French courts will have sole jurisdiction.
